If the EPA  did issue such an exemption, the HACCP Amendment would have required the state to comply with the EPA's guidelines for  adherence to the EPA's noncritical controls. The proposal to eliminate the HACCP-based HACCP controls was approved and signed by Governor Pat McCrory on February 5, 2017. On December 8 and 20, 2017, the Board of County Commissioners, Mecklenburg County Commissioners and Mecklenburg County Schools passed Ordinances to implement the proposal for the County of Mecklenburg to seek EPA's approval to implement HACCP rules for a minimum of six months after the County received EPA's notice of proposed rule making (NORM).
